At Maximal Learning, we care about your personal data, so we have prepared this Privacy Policy to explain how we collect, use and share it.

This Privacy Policy describes our policies and procedures on the collection, use and disclosure of your information when you use the Service and tells you about your privacy rights and how the law protects you.

We use your information and personal data to provide and improve the Maximal Learning website, other affiliated software and products (“the Service”). By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy.

 

A. Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

 

B. Definitions

For the purposes of this Privacy Policy:

  • Company (referred to as either "the Company", "we", "us" or "our" in this Agreement) refers to Maximal Learning, Inc, a company registered in the United States.

  • Cookies are small files that are placed on your computer, mobile device or any other device by a website, containing the details of your browsing history on that website among its many uses.

  • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

  • Personal Data is any information that relates to an identified or identifiable individual.

  • Service or Services refers to the Company's Website. It may also refer to other interactions you have with the Company, for example through surveys, interviews, and focus groups.

  • Service Provider means any natural or legal person who processes data on behalf of the Company. It refers to third­ party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.

  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

C. Security

Maximal Learning has developed our Service with security in mind.

When you utilize our products and services, You are utilizing your computing device to access a cloud-based or proprietary server computing device.  Maximal Learning takes steps to protect and secure data during transmission and in the cloud-based or proprietary server computing device through encryption and other measures. We take steps to securely send and store data, and only work with business partners and cloud Service Providers who provide assurances that they will do the same.


Maximal Learning strives to protect the information provided to and/or collected by us when you use our Services and Products through commercially reasonable administrative, technical, and organizational safeguards. While Maximal Learning works hard to protect your information, no security method is 100% secure. Thus, Maximal Learning cannot guarantee that the security methods and/or precautions we take are failure proof.

We recommend that you learn about and use security tools, habits, and practices to protect your online security, such as protecting your email and passwords and phone number from others and having a backup copy of this information in a safe and secure location.

D. Information or Data Collected by Company/Maximal Learning

1. Personal Data

While using our Service, we may collect certain personally identifiable information that can be used to contact or identify you. Your name and email address may be provided to Maximal Learning by Google, Apple or Discord.  Personally identifiable information may include, but is not limited to:

  • Your Name (provided during registration or initial setup of Service) 

  • Email Address

  • Phone Number

  • Age Range

  • School Year

  • Communication Preferences

  • Social Media Username

2. Usage Data

Usage Data is collected automatically when using the Service.


Usage Data may include information such as your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, what features you used in the Service, unique device identifiers and other diagnostic data.


When you access the Service by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.


We may also collect information that your browser (“Browser Information” which is also included in Usage Data) sends whenever you visit our Service or when you access the Service by or through a mobile device, including but not limited to the texts that you type in the Service.

3. Service Interaction Data

Service Interaction Data are prompts or chats that you input to the Service and prompts or chats that you receive in response to the Service. These may include tasks, tasks lists, questions, answer to questions, calendar events, or other notes or information.  In addition, the user may also provide their name or what they prefer to be called, their school, their grade level, their classes and other information shared during interfacing with the Services.  Our Product interacts with third-party artificial intelligence models of our Service Providers in order to provide answers to questions submitted by users and to assist users in planning tasks and scheduling tasks and events.  Your Service Interaction Data that is submitted to the third-party AI models does not include your Personal Data or any Usage Data.  Maximal Learning does this to minimize the risk of the third-party AI models having and utilizing any of Your Personal Data.  Please note that the name provided during registration or initial setup of the Services is not submitted to the third-party AI models; however, if you utilize your name during conversations with the Services, that information would be shared with the third-party AI models.

 

4. Feedback Data

Maximal Learning may receive Feedback Data from Users.  Feedback Data is information and data that you provide to Maximal Learning identifying improvements, bugs, your thoughts on the Maximal Learning Service, your thoughts on products and software to integrate with the Maximal Learning Service. It may also include information and data that you provide to Maximal Learning in participation in video conferencing calls, responses to electronic surveys, participation in direct messaging in private social media channels (e.g., Discord) and/or responding to Maximal Learning emails.  In certain circumstances, the video conferencing calls are recorded if consent is received by the users.

5. Tracking Technologies and Cookies

We use Cookies and similar tracking technologies to track the activity on our Service and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze our Service. The technologies we use may include:

  • Cookies or Browser Cookies. A cookie is a small file placed on your Device. You can instruct your browser to refuse all Cookies or to indicate when a Cookie is being sent. However, if you do not accept Cookies, you may not be able to use some parts of our Service. Unless you have adjusted your browser setting so that it will refuse Cookies, our Service may use Cookies.

  • Web Beacons. Certain sections of our Service and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of a certain section and verifying system and server integrity).   Maximal Learning utilizes pixels to track visitors on the Services and track conversions from visitors.  In addition, Maximal Learning utilizes a tag or pixel manager to quickly gather information from pixels or tags.

Maximal Learning utilizes a form and software tool or program that collects user information and/or feedback.  UTM parameters are passed from Maximal Learning’s advertisements to the form and software tool in order to allow Maximal Learning to track from what campaign and/or specific ad a user interacted with before submitting a form and/or survey.

 
Maximal Learning utilizes a landing page builder to create and optimize custom landing pages to improve conversion rates and/or test different versions of landing pages.  


Maximal Learning utilizes an analytic software tool to track and report website traffic and partial user behavior (e.g., clicks, time on site, etc.) to help understand and optimize online Service and/or Product performance.  


Cookies can be "Persistent" or "Session" Cookies. Persistent Cookies remain on your personal computer or mobile device when you go offline, while Session Cookies are deleted as soon as you close your web browser.

  • To manage communication between You and our Services, specifically to contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities of the Services, including  security updates, when necessary or reasonable for their implementation.

  • To provide you with news, special offers and general information about Services and events which we offer that are similar to those that you have already attended, participated in or enquired about unless you have opted not to receive such information.

  • To manage your requests: to attend and manage your requests to us.

  • To tailor communication subjects of the Services for you as a User.

  • To provide, maintain, develop, support, and improve our Service, including to monitor the usage of our Service.

  • To identify the types of devices that are accessing the Service in order to improve performance of the Service. 

  • We may use your Usage Data for other purposes, such as data analysis, identifying usage trends, and to evaluate and improve our Service, products, services, marketing and your experience

3. How Company Utilizes Service Interaction Data

  • We utilize Service Interaction data to provide, develop, support and improve our Service.

  • We utilize Service Interaction Data to train and enhance the  artificial intelligence (AI) models of third parties and/or also the customized version of the AI models.

  • We may use your Service Interaction Data for other purposes, such as data analysis, identifying usage trends, and to evaluate and improve our Service, products, services, marketing and your experience.

  • We may also use your Service Interaction Data with our product, including texts in the chat, to correct bugs and make improvements to our product. 

  • With Service Providers: we may share your Service Interaction Data with Service Providers in order to provide our Service, and to monitor and analyze the use of our Service.

4. How Company Utilizes Feedback Data

  • We may use your Feedback Data for purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.

  • We may use your Feedback Data to correct bugs and make improvements to our product.  

  • We may use your Feedback Data to test out new features and functions in Our Service and Product and receive user interest in new features and function.  

  • We may use your Feedback Data to identify what external third-party products or services may be utilized in conjunction and/or potentially be integrated with our Service and Product.

  • We may use your Feedback data to show our management, investors, legal representatives and financial investors information about our Service and Product and future interactions with your Service and Product.

5. How Company Utilizes Tracking Technologies and Cookies

  • To track and report website traffic and some user behavior (e.g., clicks, time on site, etc.) to help understand and optimize online performance.

  • To track conversions from ads and optimize ads based on collected data.

  • To track which source (Instagram, Facebook, Reddit, etc.), campaign and specific ad that a user interacted with that led them to submit our surveys, sign-up forms, or access our Services.

  • To test different versions of landing pages in order to optimize marketing campaigns

F. How Company Shares Your Information

Maximal Learning is committed to protecting your personal data and transparency about how we use it.


We do not sell Usage Data, or Service Interaction Data.  We do not sell user Feedback Data .  


We do not sell your Personal Data. However, we use cookies for behavioral advertising that involve sharing data with third-party advertising partners. Under certain privacy laws, this may be considered a “sale” of Personal Data. If this determination applies, the sharing of data through cookies is the only context in which your Personal Data is “sold”.

1. We may share your Personal Data, Usage Data, and Service Interaction Data in the following situations:

  • With Service Providers: we may share your Personal Data and Usage Data with Service Providers in order to provide our Service and Product, and to monitor and analyze the use of our Service and Product.

  • With Acquiring Partners or Successors-In-Interest – We may share your Personal Data, Your Usage Data and Your Service Interaction Data in the case of, any merger, sale of Company assets, financing, or acquisition of all or a portion of our business to another Company.

  • With other users: Maximal Learning does not share your Personal Data, Usage Data, and Service Interaction Data with other users; however, when you share personal information or otherwise interact in a third-party public area (such as a community platform with other users), such information may be viewed by all users and may be publicly distributed outside.

  • With our AI Large Language Model Service Providers – We share your Service Interaction Data with our AI Large Language Model Providers to assist Maximal Learning in providing responses to your chat questions and/or inquiries.  We do not share your Personal Information or your Usage Data with our AI Large Language Model Providers.

  • With external calendaring application providers – With your consent or upon your request (as set up under account settings), we receive and/or communicate your Personal Information and Your Service Interaction Data with external calendaring applications. With your consent: we may disclose your Personal Information, Your Usage Data and Your Service Interaction Data for any other purpose with your consent.

2. We may share your Feedback Data in the following situations:

  • We may share your anonymized Feedback Data with outside investors, legal advisors and/or financial advisors to illustrates how our Product works and potential new features and functions.  

  • We may use your anonymized Feedback Data to identify what external third-party products or services may be utilized in conjunction and/or potentially be integrated with our Service and Product.

  • With Service Providers: we may share your anonymized Feedback data with Service Providers in order to improve our Service and Product with respect to our Service Providers.

  • We may receive and share your Feedback Data with external Social Media platforms, messaging providers, and email providers, in order to facilitate video conferencing calls, direct messaging, email, community forums and private channel discussions.  

  • With Acquiring Partners or Successors-In-Interest – We may share your Feedback Data in the case of, any merger, sale of Company assets, financing, or acquisition of all or a portion of our business to another Company.

 

G. Retention of your Information

The Company will retain your Personal Data and Service Interaction Data only for as long as is necessary for the purposes set out in this Privacy Policy.  We will retain your Personal Data and Service Interaction for the life of your account.  The life of your account is the time that your account is active plus a one-year inactive period (to allow you to rejoin the platform for a next education period or school year).

 
The Usage Data is indexed to a unique ID.  Usage Data indexed to a unique ID is stored for one year.  The Usage Data is anonymized after one year and the anonymized Usage Data is stored indefinitely.  Usage data is used to strengthen the security or to improve the functionality of our Service.


We will retain and use your Personal Data, Usage Data and Service Interaction Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.


We will retain your Feedback Data indefinitely.  This information is utilized to improve the functionality and features offered with our Service and Product.

H. Transfer/Storage of your Personal Data, Usage Data, Service Interaction Data and Feedback Data

Your information, including Personal Data, Usage Data, and Service Interaction Data is processed at the Company's operating offices and in any other places where the parties involved in the processing (such as our Third-Party Cloud Service Providers) are located. It means that this information may be transferred to and maintained on computers located outside of your state but within the United States where the data protection laws may differ than those from your jurisdiction.


Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.


The Company will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data, Usage Data and Service Interaction Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.


Your Feedback Data is processed at the Company’s operating offices and In other places where the parties involved in the Feedback Data processing are located (such as Third-Party Cloud Service Providers, Third-Party Social Media Platforms and Third-Party Survey Providers are located.

I. Rights with Respect to Your Personal Data, Usage Data and Service Interaction Data

You have the right to know and/or access the Personal Data, the Usage Data, and the Service Interaction Data that Maximal Learning has collected about you.  


You have the right to correct inaccurate Personal Data that we have collected from you.  

 

You have the right to delete or request that we assist in deleting the Personal Data that we have collected about you. Our Service may give you the ability to delete certain information about you from within the Service.

You have the right to OPT-OUT of the sharing of your Personal Data for cross-context behavioral advertising.

Under certain circumstances, the Company may be required to disclose your Personal Data, your Usage Data and your Service Interaction Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).


As specific examples, Maximal Learning may disclose your Personal Data, Usage Data and your Service Interaction Data in the good faith belief that such action is necessary to:

  • Protect and defend the rights or property of the Maximal Learning

  • Prevent or investigate possible wrongdoing in connection with the Service and Product

  • Protect the personal safety of Users of the Service and Product or the public

2. Data received from other cloud providers:

Our Service's use and transfer to any other app of information received from Google APls adheres to the Google API Services User Data Policy, including the Limited Use requirements.

3. Children's Privacy:

Our Service and Product is not to be utilized by anyone under the age of 13 and is not directed to users under the age of 13. We do not knowingly collect personally identifiable information or Personal Data from anyone under the age of 13. If you are a parent or guardian and you are aware that your child has provided us with Personal Data or Service Interaction Data, please contact us. If we become aware that we have collected Personal Data and Service Interaction Data from anyone under the age of 13, we take steps to remove that information from our servers and our Service Providers.
