Australia & New Zealand Addendum
MAXIMAL LEARNING’S ADDENDUM TO PRIVACY POLICY AND TERMS OF SERVICE FOR AUSTRALIA AND NEW ZEALAND

Maximal Learning (the “Company”) will be initiating a testing program in Australia and New Zealand where individuals who are 14 years of age or older can interact with Maximal Learning’s Services (Services including but not limited to the web site located at  https://maximallearning.com and other subdomains (collectively, the “Website”) and related application programming interfaces (“APIs”), online services including channels on social media sites any Downloadable Content (as defined below), and any other products and services that Company may provide now or in the future).
The Privacy Policy and Terms of Service provided on the Website apply to the testing program in Australia and New Zealand. In addition, additional information regarding privacy in Australia and New Zealand and clarifications for specific terms are provided below.
Users of the Maximal Learning Services are required to be 14 years of age or older and must agree (by clicking on a checkbox) that they are 14 years or older and that their parents have reviewed the Privacy Policy and Terms of Service (and thus this Addendum) (collectively the “Agreements”) and agree to be bound by these Agreements.
Privacy Policy
Maximal Learning believes that it abides by the Privacy Principles outlined in Australia’s Privacy Act 1998 and New Zealand’s Privacy Act 2020 (collectively the “Privacy Acts”) and any subsequent changes and amendments to each of these Privacy Acts. Maximal Learning’s Privacy Policy provides the details on how the Company adheres to and abides by the Privacy Principles of these Privacy Acts. Clarification of specific Privacy Principles are provided below.
Australia’s Privacy Principle 2 allows individuals or users to remain anonymous if they so desire, and use pseudonyms for personal data when possible. If a user of Maximal Learning’s Services wishes to remain anonymous, then during the registration process the user may login under a pseudonym name rather than supplying their name (i.e., personal data). If a user has logged in using an email or social media system and their email address or social media handle does not include their name, then these users will be anonymous in Maximal Learning’s system (because the user’s name has not been provided). If the user or individual wants to remain anonymous and their email address or social media handle includes their name, then the user or individual should login via Maximal Learning’s normal registration process utilizing a login method that does not include their name.
Maximal Learning has implemented security measures to protect the stored personal information from risks such as data interference, data loss, data misuse, unauthorized access, data modification and/or unauthorized disclosure. As mentioned in our Privacy Policy, Maximal Learning works hard to protect your information, but no security method is 100% secure. Thus, Maximal Learning cannot guarantee that the security methods and/or precautions we take are failure proof.
Maximal Learning is a United States-based company. Maximal Learning stores the user’s Personal Data, Usage Data, Service Interaction Data and Feedback Data (which are all defined in the Maximal Learning Privacy Policy and collectively are referred to herein as the “User Information”) on cloud-based server computing devices in the United States. Maximal Learning adequately protects the User Information and the collected User Information is subject to privacy laws that provide comparable safeguards to the Australia Privacy Act and the New Zealand Privacy Act.
Terms of Service
The Digital Millenium Copyright Act (“DMCA”) provisions outlined in Section 13.3 of the Terms of Service do not apply to users in Australia and New Zealand because the DMCA is a United States statute. Users or individuals who believe that content in the Maximal Learning Services infringes their Intellectual Property rights should send Maximal Learning a takedown notice that is sufficient under Australia and New Zealand law in order for Maximal Learning to evaluate whether or not the allegedly infringing content should be taken down. This takedown notice should provide a name of the copyright owner of the content and contact information, establish ownership of the allegedly infringing content, and identify where in the Maximal Learning Services the infringing content is located. This takedown notice can be emailed to support@maximallearning.com or be sent via international mail to Maximal Learning Inc., 1915 140th Ave NE Suite D2 #1324, Bellevue, WA 98005.
